The unknown value of mediation in sport disputes

From a multimillion dollar sponsorship contract to deterioration of relationships within the board room, between a player and a coach, whether at international or national level, most sports disputes are suitable for mediation, particularly where there is a working relationship to maintain between parties.

Sport Resolutions will be hosting a session on the benefits of mediation in sports disputes on Thursday 2nd February 2023. The event will take place at the Sport Resolutions office, 1 Paternoster Lane, St Paul’s, London, EC4M 7BQ, between 18:00 and 20:00, followed by some time for networking. Drinks and snacks will be provided.

Carol Couse, Sport Resolutions panel member, FIFA mediator, and a partner at Mills & Reeve will be delivering the seminar with the aim of raising awareness and increasing knowledge around sport mediation, with a particular focus on how the mediation process works and how it can be implemented within existing dispute resolution frameworks.

Leanne O’Leary, Sport Resolutions mediator and a member of the World Netball Governance Committee, will also be providing her views on implementing mediation as part of sporting bodies’ existing dispute resolution processes, from an international perspective.

Sport Resolutions Case Manager Gillian Sanders will also provide an overview of the mediation process available through Sport Integrity - the complaints, investigation and adjudication service available to high performance sport in the UK.

Carol advises clients on regulatory and commercial issues in sport, media and entertainment. She has particular expertise in football regulatory matters (player transfers, player contracts, immigration/work permit requirements). She also appears before dispute resolution forums at a domestic and international level, including before FIFA, UEFA and the Court of Arbitration for Sport (CAS).

Carol is an accredited commercial and civil mediator and is a Sport Resolutions mediator and arbitrator.  She understands the benefits of alternative dispute resolution for clients, where the need to resolve maters in a confidential and often timely way are paramount, preserving relationships where possible, She also has experience of managing multi million pound high profile cases before the ordinary courts, working alongside our expert team of litigators.

Carol became a FIFA-approved mediator earlier this year following the successful implementation of mediation within the proceedings of the Football Tribunal.

Dr Leanne O’Leary PhD FCIArb is a solicitor, arbitrator, mediator, and Senior Lecturer in Law at Edge Hill University, UK. She is a Fellow of the Chartered Institute of Arbitrators, and a CEDR-accredited and CMC-registered mediator. Leanne has extensive dispute resolution experience in sports arbitration and workplace mediation. She regularly sits as a CAS arbitrator, she is a member of the Premier League Judicial Panel, and she is an independent member of the World Netball Governance Committee.

Leanne’s research interests focus on the employment of athletes and dispute resolution in the sports industry. She is the author of Employment and Labour Relations Law in the NBA, Premier League and International Rugby Union, and she has published in leading academic law journals such as the Industrial Law Journal and The International Sports Law Journal.

Gillian joined Sport Resolutions in March 2022 as a Case Manager.

She is primarily in charge of Sport Integrity service, a confidential reporting line and independent investigation service, supporting athletes, coaches and all support personnel within the Olympic and Paralympic high-performance community across the UK.

Gillian is a lawyer who has worked in private practice both in the United Kingdom and South Africa. She was also a professional athlete, having competed in triathlon at the London 2012, Rio 2016 and Tokyo 2020 Olympic Games. Gillian also competed at the Glasgow 2014 and Gold Coast 2018 Commonwealth Games, winning a silver medal at Glasgow 2014.
